Terms of Service

These terms govern your use of this website and any purchase you make from Spec First (“we”, “us”). By using the site or placing an order, you agree to them. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.

1. Eligibility

To place an order you must be at least the age of majority where you live, or have the permission of a parent or guardian. You agree that the information you give us is accurate and complete.

2. Products

We describe and photograph our products as accurately as we can, but colors may look slightly different on your screen and sizes may vary within normal manufacturing tolerances. All products are subject to availability, and we may change or discontinue products at any time.

3. Prices and payment

Prices are shown in the currency displayed on the site and may change at any time before you place your order. Applicable taxes, duties and shipping charges are shown at checkout. You can pay in cryptocurrency through our payment processor, NOWPayments, or by PayPal invoice arranged through a ticket on our Discord server. For crypto payments, the amount due in your chosen coin is calculated from the order total when you pay; you are responsible for network fees and for sending the full amount before the payment window closes. Your order is confirmed only once payment is received in full, and unpaid orders are cancelled automatically. If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund you in full, even after it has been confirmed.

4. Orders

After you place an order we send you an email acknowledging it. A contract between us is formed when we dispatch your order. We may refuse or cancel an order, for example if a product is unavailable, we cannot verify your payment, or we suspect fraud. If we cancel after taking payment, we refund you in full.

5. Shipping, returns and refunds

Delivery, returns and refunds are covered by our Shipping and Returns policy, which forms part of these terms. Ownership and risk of loss pass to you on delivery.

6. Intellectual property

The Spec First name, logos, designs, photography, video, text and other content on this site belong to us or our licensors and are protected by intellectual property law. You may view the site for personal, non-commercial use, but you may not copy, reproduce or use its content without our written permission.

7. Acceptable use

You agree not to misuse the site, including by attempting to access it in unauthorized ways, interfering with its operation, scraping it with automated tools, introducing malicious code, or buying products for unauthorized commercial resale.

8. Third-party services

Payments are processed by NOWPayments and PayPal, and PayPal orders are arranged on Discord. Your use of those services is also subject to their terms. We are not responsible for third-party websites linked from this site.

9. Disclaimer

Apart from the guarantees given to you by law, the website is provided “as is” and “as available”. We do not promise it will always be uninterrupted or error free.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of profit, business or data, and our total liability for any order is limited to the amount you paid for it. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.

11. Governing law and disputes

These terms are governed by the laws of the State of California, USA. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your local courts. Before starting any legal claim, please contact us so we can try to resolve the issue informally.

12. Changes and general terms

We may update these terms from time to time; the version in force when you place an order applies to that order. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a right does not waive it. These terms, together with the policies they refer to, are the entire agreement between us about your use of the site and your purchases.
